1. Terms of Service
Effective Date: December 4, 2025
These Terms of Service ("Terms") are entered into by and between MythicWare LLC, a Wyoming limited liability company ("MythicWare," "we," "us," or "our"), and you ("User," "you," or "your"), and govern your access to and use of the VoiceLegacy service (the "Service"), including any content, functionality, and services offered on or through yourvoicelegacy.com (the "Website") or via our mobile-optimized web application or our phone call service.
PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICE.
1. Acceptance of Terms & Geographic Restriction
BY CLICKING “I ACCEPT, creating an account, accessing the Website, or using the Service, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.
Geographic Restriction: The Service is intended only for access and use by persons located in the United States and Canada. If you access the Service from outside these regions, you do so on your own initiative and are responsible for compliance with local laws.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Website or via email. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
2. Description of the Service
VoiceLegacy is a premium platform that provides:
- AI Companionship: 24/7 conversational AI companions for emotional support, companionship, and interactions via voice calls, text messaging, and journaling features.
- Voice Cloning: Tools to create and preserve digital voice replicas for legacy preservation, memorial purposes, and ongoing connections.
- Memory Preservation: Features to record, transcribe, store, and reference personal stories, conversations, and events.
- Additional Features: Call history analysis, phone number integration, and post-call summaries.
The Service integrates third-party providers (e.g., ElevenLabs for voice cloning, Retell AI for calls) and is detailed further in Section 12 as being for entertainment and general companionship purposes only. It is not a substitute for professional medical, psychological, or therapeutic advice.
3. Account Registration and Security
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the confidentiality of your login credentials and notify us immediately of any unauthorized use.
- Be solely responsible for all activities under your account.
We reserve the right to suspend or terminate accounts for violations of these Terms or suspicious activity. You may not share your account or use another's credentials.
4. Payments and Billing
The Service is a paid subscription service. All fees are non-refundable except as expressly stated.
- Subscriptions: Monthly or annual plans (e.g., Intro, Basic, Premium) with auto-renewal. You may cancel anytime via your account settings; access continues until the end of the billing period.
- Voice Cloning: One-time fees (e.g., Basic Clone, HD Clone) paid upfront. Refunds are not available for subjective dissatisfaction with voice likeness or quality. Refunds are only issued if technical failures prevent the generation of the model entirely.
- Add-Ons: Minute bundles and phone numbers are non-refundable.
- Taxes: You are responsible for all applicable taxes.
- Payment Processor: We use Stripe for secure processing. By providing payment information, you authorize recurring charges.
5. Acceptable Use Policy
You may use the Service only for lawful purposes. Prohibited activities include:
- Illegal conduct, harassment, or abuse toward AI or other users.
- Cloning voices without explicit consent (see Section 6).
- Reverse engineering, scraping, or unauthorized commercial use.
- Sharing accounts or selling access.
- Uploading harmful content (e.g., malware) or violating third-party rights.
- Using the Service to provide professional medical/therapeutic services.
6. Voice Consent, Rights, and User Content
- Consent for Cloning: You represent and warrant that you have all necessary rights and consents to clone any voice uploaded to the Service. You indemnify us against any claims arising from lack of consent.
- Living Individuals: You must possess written permission from the individual.
- Deceased Individuals: You represent that you are the Executor of the estate or have written authorization from the Executor/next of kin to create a digital replica of the deceased’s voice. You agree to provide such proof to MythicWare within 24 hours if requested.
- User Content Ownership: You retain ownership of your recordings, transcripts, journals, and memories ("User Content"). By uploading, you grant us a worldwide, irrevocable, royalty-free license to use, store, process, analyze, and improve the Service (including AI training).
- Our Rights: We own all AI models, algorithms, and platform technology. We may delete User Content upon termination or for legal reasons.
7. Third-Party Integrations and Services
The Service relies on third parties (e.g., ElevenLabs, Retell AI, Stripe, Supabase, OpenAI, Groq). Your use is subject to their terms. We are not liable for their performance, outages, or data handling.
8. Service Availability and Modifications
We strive for reliability but provide the Service "AS IS" without uptime guarantees. We may perform maintenance, update features, or discontinue aspects of the Service with reasonable notice. You acknowledge potential interruptions.
9. Intellectual Property
All trademarks, copyrights, and IP in the Service (excluding User Content) are owned by MythicWare or licensors. You may not infringe them. We respect third-party IP; report violations to [email protected].
10. Termination
You may terminate your account anytime. We may suspend or terminate for violations, non-payment, or legal reasons. Upon termination, you lose access; outstanding fees remain due.
11. Dispute Resolution
- Informal Resolution: Contact [email protected] to resolve issues.
- Arbitration: Any disputes not resolved informally shall be settled by binding arbitration in Cheyenne, Wyoming, under American Arbitration Association rules. You waive class actions and jury trials.
- Canadian Users: If you are a resident of Canada, mandatory provisions of local consumer protection laws may apply to you, and nothing in these Terms limits your rights under such laws. Where permitted, you agree to resolve disputes via the arbitration process outlined above.
- Small Claims Exception: Claims under $10,000 may be in small claims court.
12. Important Disclaimers and Limitation of Liability
CRITICAL NOTICE: THE SERVICE IS NOT A MEDICAL, PSYCHOLOGICAL, OR THERAPEUTIC PROVIDER. AI INTERACTIONS ARE FOR ENTERTAINMENT, COMPANIONSHIP, AND PRESERVATION PURPOSES ONLY. DO NOT RELY ON THE AI FOR EMERGENCY HELP, MEDICAL ADVICE, LEGAL COUNSEL, OR LIFE DECISIONS. IF YOU EXPERIENCE DISTRESS, CONTACT PROFESSIONALS (E.G., 911 OR A THERAPIST). WE ARE NOT RESPONSIBLE FOR AI RESPONSES OR ANY ACTIONS YOU TAKE BASED ON AI RESPONSES.
To the maximum extent permitted by law:
- No Warranties: The Service, including AI outputs, voice clones, transcripts, and analyses, is provided "AS IS" and "AS AVAILABLE" without warranties of any kind kind—express, implied, statutory, or otherwise—including merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. AI may produce incorrect, harmful, biased, or offensive content; voices may not perfectly replicate; calls may disconnect.
- Limitation of Liability: MythicWare and its affiliates ("Released Parties") shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, emotional distress), even if advised of the possibility. This includes without limitation: harm from AI conversations, advice, errors in voice cloning or memory recall, unauthorized access, data breaches, or loss of User Content .
- Aggregate Liability Cap: Our total liability to you shall not exceed the greater of (i) the amount you paid us in the 12 months preceding the claim or (ii) $500.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, losses, damages, liabilities, costs, and expenses (including attorneys' fees) arising from: (i) your User Content or violations of these Terms; (ii) your use of the Service (including AI interactions); or (iii) lack of consent for voices.
14. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of laws principles. Venue for any non-arbitrated matters is Cheyenne, Wyoming.
15. Miscellaneous
- Entire Agreement: These Terms constitute the full agreement between us.
- Severability: Invalid provisions do not affect the rest.
- No Waiver: Our failure to enforce is not a waiver.
- Assignment: We may assign; you may not without consent.
- Force Majeure: We are not liable for delays due to events beyond control.
